These terms set out the basis on which Real Estate Concierge provides its concierge and referral service, and the basis on which you may use this website. Please read them before engaging us.
1. Agreement
By using this website, submitting an enquiry or engaging Real Estate Concierge (“we”, “us”, “our”), you agree to these terms. If you do not agree with them, please do not use the site or our service.
2. What we do
Real Estate Concierge is a personalised concierge and referral service. We take the time to understand what you are trying to achieve, we research and shortlist real estate agents and related professionals, we introduce you to the ones we believe suit your circumstances, and we help coordinate the process from first conversation through to settlement.
We are not the selling or buying agent. We do not list properties, hold or handle trust money, negotiate as your appointed agent, or perform work that requires a real estate licence on your behalf. All agency work is carried out by the licensed agent you appoint, under their own agency agreement with you.
3. Our fees and referral arrangements
The initial consultation is free and there is no obligation to proceed. In most engagements our service costs you nothing, because we may receive a referral fee or a share of commission from the agent or provider you choose to engage. Any such arrangement is between us and that agent and does not increase the commission or fees you pay.
If a particular engagement would involve a fee payable by you, we will tell you in writing what that fee is, and you will have the opportunity to agree to it, before any work begins. You are never obliged to engage an agent we introduce.
4. No professional advice
Information we provide, including anything published on this website, is general in nature. It is not legal, financial, taxation, credit, valuation or investment advice, and it does not take your particular objectives or circumstances into account. Property decisions carry risk. Before acting, you should obtain independent advice from a qualified solicitor or conveyancer, accountant, financial adviser, valuer or building and pest inspector as appropriate.
5. Agents and third-party providers
We select the agents and providers we recommend with care, based on our own research and experience. However, they are independent businesses. We do not control their conduct, their advice, the accuracy of their marketing, the price achieved for a property, or the outcome of any transaction, and we are not responsible for their acts or omissions. Your engagement with any agent or provider is a separate contract between you and them.
6. Your responsibilities
So that we can help you properly, you agree to give us accurate and complete information about your property and your circumstances, to tell us if anything material changes, and to make your own enquiries and obtain your own advice before entering any contract. You also agree not to use this website unlawfully, or to attempt to interfere with its operation or security.
7. Enquiries and communication
When you submit an enquiry, you consent to us contacting you by phone, e-mail or text about it. We aim to respond to every enquiry promptly, usually the same day, but we do not guarantee a response time. Do not send confidential or sensitive material through the website form.
8. Website content and availability
We try to keep the content of this website current and accurate, but we do not warrant that it is complete or error-free, and it may change without notice. We also do not guarantee that the site will be available without interruption. Photographs on this site are illustrative and do not depict specific properties available for sale.
9. Intellectual property
The design, text, graphics and branding of this website are owned by Real Estate Concierge or used with permission. You may view and print pages for your own personal use. You may not reproduce, republish, adapt or use any part of this site commercially without our written permission.
10. Links to other sites
Where we link to a third-party website, we do so for convenience. We do not endorse and are not responsible for the content, products, services or privacy practices of any site we link to.
11. Liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
Subject to that, and to the extent permitted by law, we exclude all liability for indirect or consequential loss, including loss of profit, loss of opportunity or loss arising from a property transaction not proceeding; and where we are liable, our total liability is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied.
12. Privacy
We handle personal information in accordance with our Privacy Policy, which forms part of these terms.
13. Ending an engagement
Either of us may end our engagement at any time by telling the other. Ending it does not affect any referral arrangement already in place with an agent you have appointed, or any obligation either of us has already incurred.
14. Changes to these terms
We may update these terms from time to time. The version published on this page applies to your use of the site and to any engagement entered into after the date shown at the top.
15. Governing law
These terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State.
